These Terms & Conditions (“Agreement”) govern your relationship with PilotMagnet, doing business as “PilotMagnet” (“Agency”, “we”, “us”, or “our”). By signing up for our marketing services, you (“Client”) agree to the following:

1. Services Provided

PilotMagnet provides digital marketing services including, but not limited to:

- Paid Facebook and Google Ads

- Landing page design and optimization

- Email and SMS marketing

- Review generation campaigns

- CRM setup and lead automation via the PilotMagnet platform (powered by a whitelabeled system)

PilotMagnet reserves the right to determine the best combination of services to achieve the goal of generating leads and booked discovery flights for the Client.

2. Term and Billing

- All engagements begin with a 3-month commitment, followed by month-to-month service.

- Client is billed a fixed retainer fee every month starting from the date of the first invoice.

- After the initial term, pricing and commission structures may change with 14 days’ written notice.

- Payment is due upon invoicing and will recur monthly unless canceled per the terms below.

- All payments are non-refundable, regardless of performance or usage.

3. Client Responsibilities

To ensure campaign success, the Client agrees to:

- Provide timely branding materials (logos, photos, etc.)

- Approve ad copy, creatives, and landing pages promptly

- Answer inbound leads (calls, texts, emails)

- Create and upload organic content to Facebook and Instagram

- Confirm and provide discovery flight availability

- Update the status of each lead post-discovery flight in the CRM

- Attend weekly calls during month 1, then bi-weekly thereafter

Failure to fulfill these responsibilities may impact performance and does not constitute grounds for refund or early termination.

4. Termination

- After the 3-month minimum term, either party may cancel services with 48 hours’ notice prior to the next billing cycle.

- Cancellations must be submitted in writing (email is acceptable).

- No partial month refunds or prorated billing is available.

- Failure to pay may result in paused services or termination.

5. Intellectual Property

PilotMagnet retains ownership of any proprietary marketing systems, templates, copy, funnels, automation, and ad strategy frameworks. All lead data and custom branding assets created specifically for Client are Client’s to keep.

6. Confidentiality

Both parties agree to keep confidential any non-public information exchanged during the course of this engagement, including but not limited to business strategy, ad performance data, and login credentials. This obligation survives termination of the Agreement.

7. No Guarantees

Client acknowledges that PilotMagnet does not guarantee any specific results such as the number of leads, booked flights, or sales. Marketing performance varies based on numerous factors including competition, budget, local market, and internal sales process.

8. Limitation of Liability

To the fullest extent permitted by law, PilotMagnet shall not be liable for any indirect, incidental, or consequential damages arising out of or related to the services provided. In no event shall our total liability exceed the amount paid by Client in the preceding 30 days.

9. Modifications

We may update these Terms & Conditions at any time with 14 days’ notice. Continued use of our services after such changes constitutes your agreement to the new terms.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of Florida.

By signing up for services with PilotMagnet or paying your first invoice, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
